End-User License Agreement (EULA) for Gold Eagle Mini App

1. Acceptance of Terms

By accessing or using the Gold Eagle Mini App (“the App”), you agree to be bound by the terms of this End-User License Agreement (“EULA”). If you do not agree to these terms, you must immediately discontinue use. By clicking 'Accept' or installing the App, you acknowledge that you have read, understood, and agreed to this EULA.

2. Definitions

  • •Developer: Gold Eagle, the entity that owns and operates the App.
  • •User: Any individual or entity that accesses or uses the App.
  • •App: The Gold Eagle Telegram Mini App, including all related features, services, and tasks.
  • •Content: Any text, images, audio, video, tasks, or other material made available through the App.

3. Eligibility
To use the App, you must:

  • •Be at least 18 years old.
  • •Not reside in a restricted jurisdiction or be subject to sanctions.
  • •Have the legal capacity to enter into this Agreement.

4. License Grant

Gold Eagle grants you a limited, non-exclusive, non-transferable, and revocable license to use the App for personal, non-commercial purposes, subject to compliance with this EULA. You may not sublicense, sell, modify, reverse-engineer, or distribute the App or any of its content without prior written consent.

5. User Responsibilities
You agree not to:

  • •Transmit viruses, malware, or harmful code.
  • •Engage in unauthorized data collection, scraping, or mining.
  • •Reverse-engineer, decompile, or tamper with the App's code or security features.
  • •Share false, misleading, or fraudulent information.

6. Privacy and Data Use

Gold Eagle collects and processes User data as described in its Privacy Policy. By using the App, you consent to such collection and processing. Personal data may include:

  • •Profile information (eg, username, profile picture).
  • •Usage data (eg, IP address, logs).
  • •Third-party data shared through integrations.

Gold Eagle is not responsible for third-party data processing practices. Users should review the privacy policies of third-party providers before engaging with them.

7. Content Ownership and Rights

  • •Users retain ownership of content they create and share through the App.
  • •By uploading content, you grant Gold Eagle a worldwide, royalty-free license to use, distribute, and display your content within the App.
  • •The App’s features, design, and software are the intellectual property of Gold Eagle and are protected by applicable copyright and trademark laws.

8. Transactions and Payments

  • •Transactions conducted through the App, including token purchases, are facilitated by third-party payment providers and are non-refundable.
  • •Gold Eagle is not liable for losses arising from third-party services, technical failures, or unauthorized access.
  • •Users are responsible for complying with tax laws related to their transactions and bear full responsibility for any financial risks.

9. Risks and Disclaimers

The App provides access to blockchain-based services and tokens, which are volatile and may involve financial risk. Gold Eagle does not guarantee returns, value stability, or liquidity of any digital assets.

The App also provides access to in-App partnership tasks, which are intellectual property of third-party providers and not Gold Eagle. Users acknowledge the following risks:

  1. •Loss of value or assets due to market volatility.
  2. •Regulatory changes impacting cryptocurrency transactions.
  3. •Technology failures, including bugs, downtime, or hacking incidents.
  4. •Compliance risks associated with third-party integrations.

10. Refund Policy

When you purchase any of our offerings, post payment clearance, your access to use the corresponding resources will be activated. Once the resource access is activated, no refunds (partially or fully) are processed.

Before buying an offering, it is your sole responsibility and obligation to do your own research. No refunds will be issued due to dissatisfaction with the product.

11. Limitation of Liability

Gold Eagle shall not be liable for any:

  1. •Indirect, incidental, or consequential damages.
  2. •Loss of profits, data, or goodwill.
  3. •Losses caused by in-App partnership tasks owned by third-party providers.
  4. •Service interruptions caused by Force Majeure events.

To the fullest extent permitted by applicable law, Gold Eagle's liability is limited to the amount paid (if any) by the User for accessing the App.

12. Termination
Gold Eagle reserves the right to suspend or terminate your access to the App at any time for violations of this EULA, unlawful activity, or other reasonable causes.

13. Updates and Changes
Gold Eagle may update or modify this EULA from time to time. Users will be notified of significant changes, and continued use after such updates constitutes acceptance.

14. Governing Law and Dispute Resolution
This EULA is governed by the laws of Delaware, USA. All disputes arising out of or relating to this EULA shall be resolved through binding arbitration in Wilmington, Delaware, USA, in accordance with the rules of the American Arbitration Association (AAA).

Exceptions: Users may seek small claims in their local jurisdiction where permitted by law. Both parties waive the right to jury trials or participation in class actions.
